Terms of Use

Please read these terms carefully before using Bright Path Academy's services.

Not Legal Advice. These Terms of Use were prepared as a good-faith effort to protect students, families, tutors, and the organization. They do not constitute legal advice. Bright Path Academy recommends that all parties consult an independent attorney for guidance specific to their situation.

1. Acceptance of Terms

By accessing or using the Bright Path Academy website (brightpathacademy.org) or any of its services — including booking tutoring sessions, submitting a tutor application, or browsing content — you ("User") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not use our services. We reserve the right to update these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.

2. About Bright Path Academy

Bright Path Academy is a volunteer-run nonprofit organization that connects students with volunteer tutors for free, supplemental academic support sessions conducted online via third-party video platforms (such as Zoom). We are a registered 501(c)(3) nonprofit organization. Our services are provided entirely free of charge to students.

3. Eligibility and Parental Consent

Age Requirement: Our services are intended for students aged 13 and older. We do not knowingly collect personal information from children under 13. If you are under 13, you may not use our services.

Minors (ages 13–17): If you are under 18 years of age, you must have the consent of a parent or legal guardian to use our services and to book or attend tutoring sessions. By booking a session on behalf of a minor, the parent or guardian represents that they have reviewed these Terms, consent to their child's participation, and accept these Terms on the minor's behalf.

Tutors: Tutor applicants must be at least 14 years of age. Applicants under 18 must have parental consent to participate as a volunteer tutor.

4. Nature of Services — Important Disclaimers

Volunteer Tutors Only. All tutors on the Bright Path Academy platform are unpaid volunteers. They are not licensed educators, certified teachers, counselors, therapists, or credentialed academic professionals unless explicitly stated. Tutoring sessions are informal, peer-to-peer educational support and should not be construed as professional instruction, academic coaching, or any form of professional service.

Supplemental Educational Support Only. Our tutoring is intended as a supplement to — not a replacement for — formal schooling, credentialed instruction, or professional academic services. Bright Path Academy does not provide curriculum, issue grades, or serve as an official educational institution.

No Professional Advice. Nothing communicated during a tutoring session or on this website constitutes professional academic, medical, psychological, financial, legal, or any other form of licensed professional advice. Users should seek qualified professionals for such needs.

No Guarantee of Results. Bright Path Academy makes no representation or warranty that participation in tutoring sessions will result in any specific academic outcome, test score improvement, grade improvement, college admission, or other result. Educational outcomes depend on many factors outside our control, including the student's effort, prior knowledge, and circumstances.

5. Tutor Screening and Responsibility

Bright Path Academy makes reasonable efforts to screen tutor applicants, including reviewing applications and conducting brief interviews. However, we do not conduct formal background checks, verify academic credentials beyond self-disclosure, or guarantee the accuracy of any information provided by tutors.

Bright Path Academy is not responsible for the conduct, statements, advice, or actions of any volunteer tutor before, during, or after a tutoring session. Users who experience inappropriate behavior should report it immediately to us via the contact page.

6. Session Conduct and Code of Conduct

All participants — students, parents, and tutors — agree to:

  • Treat all other participants with respect, courtesy, and professionalism.
  • Not engage in harassment, bullying, discrimination, or any form of abusive behavior.
  • Not share, record, screenshot, or distribute session content without the explicit consent of all participants.
  • Not solicit personal contact information, social media handles, or engage in private communication outside of session-related communication facilitated through Bright Path Academy.
  • Not use the platform for any unlawful purpose or to transmit harmful, offensive, or inappropriate content.
  • Attend or cancel sessions with reasonable notice (at least 24 hours where possible).

Bright Path Academy reserves the right to suspend or permanently remove any user who violates this code of conduct, with or without prior notice.

7. Third-Party Platforms

Tutoring sessions are conducted via third-party video platforms (such as Zoom Video Communications, Inc.). Your use of those platforms is governed by their own terms of service and privacy policies, which are separate from ours. Bright Path Academy has no control over, and assumes no responsibility for, the content, privacy practices, or operation of those third-party services.

This website uses Airtable for data storage and Formspree for form submissions. These services are also governed by their own terms and privacy policies.

8. Intellectual Property

All content on this website — including text, graphics, logos, study resources, and articles — is owned by or licensed to Bright Path Academy and is protected by applicable intellectual property laws. You may use content for personal, non-commercial educational purposes only. You may not reproduce, distribute, or create derivative works without our written permission.

Tutors who submit bios, session notes, or other content to the platform grant Bright Path Academy a non-exclusive, royalty-free license to display that content in connection with the platform's services.

9. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRIGHT PATH ACADEMY PROVIDES ITS SERVICES "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE SERVICE.

We do not warrant that the website will be free of errors, viruses, or other harmful components, or that any defects will be corrected.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRIGHT PATH ACADEMY, ITS OFFICERS, DIRECTORS, VOLUNTEERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, OUR SERVICES — INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST ACADEMIC OPPORTUNITY, EMOTIONAL DISTRESS, OR ANY OTHER INTANGIBLE LOSS.

Because our services are provided entirely free of charge, you agree that, to the extent any liability is found, the maximum aggregate liability of Bright Path Academy to you shall not exceed zero dollars ($0.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Bright Path Academy and its officers, directors, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the services; (b) your violation of these Terms; (c) any content you submit to the platform; or (d) your violation of any third party's rights.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
